By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use Thinka.
1. Eligibility
- You are at least 13 years old (or have parental or guardian consent if required by law).
- You have the legal authority to enter into this agreement.
If you are using Thinka on behalf of a school, institution, or organization, you represent and warrant that you have the authority to bind that entity to these Terms.
2. Description of Service
Thinka is an AI-powered education platform that provides:
- Automatically generated practice questions and study materials
- Tools for students to upload, review, and analyze answers
- Insights and analytics to enhance learning outcomes
We may update, modify, or discontinue any feature of the Platform at any time, with or without notice.
3. School Users and Use of Logos
For schools, educational institutions, or teachers registering on Thinka (“School Users”):
- By creating an account or using the Platform, you grant Thinka permission to display your school’s name and logo on our website and marketing materials as a participating institution.
- You may opt out of this usage at any time by contacting us at info@thinka.ai with the subject line “Opt Out of Logo Use”.
4. AI-Generated Content Disclaimer
All questions, explanations, and study content on Thinka are generated by artificial intelligence (AI).
- Such content may contain inaccuracies, outdated information, or factual errors.
- Users should verify all content with official school or examination board materials before relying on it.
- Thinka does not guarantee the accuracy, reliability, or completeness of any AI-generated information.
- We are not responsible for any academic, personal, or professional consequences resulting from reliance on AI-generated materials.
5. User Accounts
- You may need to create an account to access certain features.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- We may suspend or terminate your account if you violate these Terms or misuse the Platform.
6. User Content
Users may upload answers, handwritten notes, or other materials (“User Content”). By uploading content, you:
- Grant Thinka a non-exclusive, worldwide, royalty-free license to use, process, display, and analyze your content for educational, product development, and research purposes.
- Confirm that you own or have rights to the uploaded content.
- Acknowledge that anonymized or aggregated data may be used to improve our AI systems.
7. Intellectual Property
All rights, titles, and interests in Thinka, including but not limited to software, design, AI models, graphics, and branding, are the exclusive property of Thinka Limited.
You may not:
- Copy, reproduce, or redistribute our platform or materials
- Reverse-engineer or decompile any part of Thinka
- Use the Platform for unauthorized commercial purposes
You retain ownership of your uploaded content, subject to the license granted in Section 6.
8. Payment and Subscriptions
- You agree to pay all applicable fees as displayed at checkout.
- All payments are non-refundable except as required by applicable law.
- Thinka may modify subscription pricing or billing terms with notice.
9. Fair Use, Service Capacity and Usage Limits
The Platform is a shared service that relies on finite computing, artificial-intelligence and network resources. To preserve the stability, security and integrity of the Platform for all users, Thinka reserves the right, at its sole discretion and without prior notice, to:
- Apply rate limits. Throttle, queue, defer or temporarily restrict the number, frequency or volume of requests, submissions, generations or other interactions with the Platform, including during periods of high traffic, peak demand, or scheduled and unscheduled maintenance.
- Enforce fair use. Impose reasonable usage limits where an account’s consumption of Platform resources is, in Thinka’s reasonable judgment, excessive, abnormal or inconsistent with ordinary individual educational use, so that resources remain available to other users.
- Restrict abusive or prohibited use. Limit, suspend or terminate access where Thinka reasonably suspects automated, scripted or bulk access; scraping, harvesting or systematic extraction of content; account sharing or resale; circumvention of any limit, security or access-control measure; or any other conduct that violates these Terms or degrades the Platform for other users.
These measures may be applied to any account, including accounts on paid or premium subscription plans. A subscription grants access to the Platform’s features subject to these Terms; it does not confer any right to unlimited, uninterrupted or priority use of the Platform’s resources. Any reduction in service resulting from measures taken in good faith under this Section shall not constitute a breach of these Terms and shall not, except as required by applicable law, entitle you to any refund, credit or compensation. Where reasonably practicable, we will inform affected users of any limitation and its expected duration.
10. Limitation of Liability
To the maximum extent permitted by law:
- Thinka Limited, its affiliates, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages, including loss of data, academic results, or profits.
- Your sole remedy for dissatisfaction with the Platform is to discontinue its use.
11. Disclaimer of Warranties
The Platform and its content are provided “as is” and “as available” without any warranties, express or implied. We make no representations or warranties regarding:
- The accuracy or completeness of AI-generated content
- The availability or performance of the Platform
- Fitness of the Platform for any specific educational purpose
12. Privacy
Your privacy matters to us. Please review our Privacy Policy to understand how we collect, use, and protect your data. By using the Platform, you consent to our data practices as described in that policy.
13. Third-Party Services
Thinka may integrate with or link to third-party tools or services (e.g., payment processors, analytics providers). We are not responsible for any content, policies, or practices of third-party services.
14. Termination
We may suspend or terminate your account or access to the Platform at any time for:
- Violation of these Terms
- Misuse, fraud, or abuse of the Platform
Upon termination, your right to use the Platform immediately ceases.
15. Indemnification
You agree to indemnify and hold harmless Thinka Limited, its directors, employees, and affiliates from any claims, losses, liabilities, or damages resulting from:
- Your use of the Platform
- Your violation of these Terms
- Your infringement of any third-party rights
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the Hong Kong Special Administrative Region (HKSAR). Any dispute or claim arising from these Terms shall be resolved exclusively in the courts of Hong Kong.
17. Changes to These Terms
We may update or revise these Terms periodically. If significant changes occur, we will notify users via email or a prominent notice on the Platform. Your continued use after updates means you accept the revised Terms.
