These Creator Program Terms (the “Terms”) govern participation in the thinka Creator Program (the “Program”) operated by thinka (“thinka”, “we”, “us”). By submitting an application, and again by accepting an offer, you agree to these Terms. If you do not agree, do not apply or accept.

1. Eligibility

  • You must be at least 16 years old to apply.
  • If you are under 18, your parent or legal guardian must consent to your participation in the Program and to your receipt of rewards.
  • You must reside in a country the Program supports and have the legal right to take part where you live.
  • We may refuse, suspend or remove any participant at our discretion.

2. Relationship

Participation does not create an employment, agency, partnership or joint venture relationship. You take part as an independent party. Nothing in the Program entitles you to employment benefits of any kind, and you are not authorised to act or speak on thinka’s behalf.

3. Applications, offers and rewards

  • Applying is free and does not guarantee acceptance. We review applications and decide, at our sole discretion, whether to make you an offer and what it contains.
  • An offer may include a fixed payment per approved post, bonuses based on view counts, months of free thinka Premium, or a combination. Your exact terms are those stated in your offer.
  • Rewards are payable only for content that we have verified: posted publicly, compliant with these Terms, and submitted to us through your creator dashboard. Whether content qualifies is decided by us, acting reasonably.
  • View-based bonuses are assessed on the view counts reasonably determined by us at the time of review.
  • We may change or end the Program, or an individual offer, at any time. Rewards already earned for verified content will still be honoured.

4. Content rules

All content you create or post in connection with the Program must follow these rules. Content that does not follow them will not be rewarded and may lead to removal from the Program.

  • Disclose the partnership. Every post connected with the Program must clearly disclose your material connection to thinka — for example with “#ad”, the platform’s paid-partnership label, or an equally clear statement. This applies whether your reward is money or free Premium. This is a legal requirement in most of our markets, not just a Program rule.
  • Follow every platform’s own rules. You must comply with the terms of service and community rules of every platform, forum or community you post on, including their rules on promotional or commercial content and self-promotion. Do not post Program content in communities that prohibit promotional posts, and never present yourself as an unaffiliated user when posting about thinka.
  • Be truthful. Make only accurate claims about thinka and your own experience. Do not fabricate results, grades or testimonials.
  • No fake engagement. Buying views, likes, followers or comments, engagement pods, bots, or any artificial inflation of metrics is prohibited and treated as fraud (see Section 8).
  • Appropriate content. No unlawful, hateful, sexual, dangerous or misleading content; nothing that suggests thinka can be used for cheating in exams or coursework; do not name or depict individual teachers, students or thinka staff without their consent.
  • Your content must be yours. Do not use material that infringes anyone else’s rights (music, footage, images) beyond what the platform licenses for use in posts.

5. Payment

  • Money rewards are paid by bank transfer in your local currency to the account details you provide on your creator dashboard. You are responsible for the accuracy of those details; a payment made to the account you supplied discharges our obligation to pay it.
  • The receiving account must be held by you or, if you are under 18, by you or your parent/guardian.
  • We aim to send payment promptly after verification; transfer times depend on the banking system.
  • You are responsible for any taxes, levies or reporting obligations that apply to rewards you receive. Nothing is deducted or withheld by us unless the law requires it.
  • Premium rewards are applied to the thinka account matching the email you give us, have no cash value, and cannot be transferred or exchanged.

6. Licence to your content

You keep ownership of the content you create. In return for the rewards, you grant thinka a worldwide, royalty-free, perpetual, transferable licence to use, reproduce, adapt, translate, publish and display content you submit to the Program — including in thinka’s own marketing and in paid advertising on any platform — with attribution to your account where practical. You confirm you have the right to grant this licence for everything in your content. You may ask us in writing to stop new uses of a specific piece of content; we will do so within a reasonable time, though uses already live or committed may continue.

7. Privacy

We process the personal data in your application and dashboard (name, contact details, age band, platform links, bank details for payment) to run the Program: reviewing applications, making and managing offers, verifying content, paying rewards and meeting our legal obligations. Bank details are used only to make payments. Application data is kept for up to 24 months after your last Program activity, and longer where payment or legal records require it. Our Privacy Policy applies to everything not covered here.

8. Fraud and clawback

If rewards were obtained through fraud — including fake engagement, deleted posts re-submitted, misrepresented identity or age, or content that breached Section 4 — we may withhold unpaid rewards, revoke granted Premium, require repayment of amounts already paid, and remove you from the Program.

9. Ending participation

You may leave the Program at any time by telling us. We may end your participation at any time. When participation ends, rewards already earned for verified content are honoured; the content licence in Section 6 continues.

10. Liability

To the fullest extent the law allows, thinka is not liable for indirect or consequential losses connected with the Program. Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Changes to these Terms

We may update these Terms. The version you accept at application, and again at offer acceptance, is recorded. If we make material changes, continuing in the Program after notice of the change constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, and disputes are subject to the non-exclusive jurisdiction of the Hong Kong courts, without affecting mandatory consumer protections that apply where you live.
